Terms of Service

Agreement to terms

These Terms of Service (“Terms”) apply to M Street System, provided by Kabosh Digital Pty. Ltd.(“M Street System”, “we”, “us”), including our free business-process consultation, the business system we build for you, and our ongoing support (together, the “Service”). By using the Service you agree to these Terms. If you’re using it for a business, you confirm you have authority to agree on the business’s behalf.

The Service

M Street System is a business system set up for each business’s own requirements. Depending on what we agree with you, it can include automated workflows, information management, AI-assisted features, and access to an online IT consultant who can add features, fix problems and check for security risks.

Where we provide the Service

We provide the Service to businesses in Australia. Consultations and support happen online. The Service is for businesses, not for personal or household use.

Free consultation

Our business-process consultation is free and you’re under no obligation to go further. The advice we give is general and based on what you tell us - decisions about your business remain yours.

Free first month

After we build your system, you can use it free of charge for one month, starting on the day we give you access. You won’t be charged for the free month, and nothing is payable afterwards unless you accept our quote. If you don’t accept a quote by the end of the free month, your access ends and we handle your data as described in our Privacy Policy.

Quotes and fees

Before the free month ends, we’ll give you a written quote based on what your system does and what you need. The quote sets out the price, what’s included, how and when you’ll be billed, and whether GST is included. Fees only apply once you accept a quote, and we won’t change your price without telling you in advance.

The online IT consultant

You can ask for new features, report problems and request security checks from inside your system. We aim to respond promptly. How much new work is included in your price is set out in your quote; for larger requests we’ll tell you the cost before we start.

Your responsibilities

You’re responsible for giving us accurate information, keeping your logins secure, deciding who in your business has access, and all activity under your accounts. Let us know promptly if you think someone has accessed your system without permission.

Acceptable use

You agree not to use the Service to:

  • Break any law or infringe anyone else’s rights.
  • Send spam or other unsolicited bulk messages.
  • Store or process information you don’t have the right to use.
  • Try to access other customers’ data or interfere with how the Service runs.

Your data

Your business data stays yours. You give us permission to store and process it only to provide the Service to you. You can ask for a copy of your data at any time, including when the Service ends.

Our software

We own the M Street System software, including the parts we build or configure for your business. While you’re using the Service, you have the right to use it for your business.

AI features and third-party services

AI features produce suggestions and drafts that may sometimes be wrong. Check AI output before you rely on it or send it to anyone. Where your system connects to other services (such as your email, accounting or booking software), those services are provided by third parties under their own terms, and we aren’t responsible for their availability or changes they make.

Ending the Service

You can stop using the Service at any time in line with your accepted quote. We may suspend or end the Service if you seriously breach these Terms or don’t pay fees that are due - where practical, we’ll give you notice and a chance to fix the problem first.

Australian Consumer Law

Nothing in these Terms excludes, restricts or changes any rights you have under the Australian Consumer Law or other laws that can’t be excluded. Where the law allows us to limit our liability for a failure to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.

Limitation of liability

Subject to the Australian Consumer Law section above, we aren’t liable for indirect or consequential loss, including lost profits, revenue or data, arising from your use of the Service. Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim arose.

Changes to these terms

We may update these Terms from time to time. We’ll update the effective date above and, for important changes, let you know directly before they apply to you.

Governing law

These Terms are governed by the laws of Australia, and you and we submit to the courts that have jurisdiction there.
